User Instructions

In order to provide you with a better user experience, starting from the registration date, we offer a free 120MB storage space and 30 minutes of regular screen recording time, which is valid for 3 months. (It is recommended to perform identity authentication as soon as possible after registration, otherwise the certificate cannot be stored properly. Please be aware!)

Welcome to register as Maker IP user. This agreement is reached between users and Maker IP of Beijing Zhong Zhi Zhi Hui Technology Co., Ltd. (here below referred to as "Maker IP") on the rights and obligations of the two parties regarding the originality authentication and protection services, and is legally binding for both parties.

Users shall read through the whole agreement and complete registration process according to the tips on the web page. If users click the button "agree" during the registration process, it means users have reached an agreement with Maker IP, and fully accept all clauses of this agreement.

1. Remit of service

1.1 Maker IP provides users with the functional services like "I want to record", " I want to be authenticated ", "I want to obtain evidences" "I want an assertion of rights" and "Defensive publication".

1.1.1 "I want to record" function enables users to upload and record the original work via Maker IP in text, picture, video or other formats.

1.1.2 "I want to be authenticated" function enables the witness and authentication of users' original works via Maker IP. Maker IP provides technical means like digital signature, timestamp, and third party CA authentication, so as to solidify the original work creation process and final results, which is unique and invariant.

1.1.3 "I want to obtain evidences" function enables users to obtain evidences to prove the ownership of the original works via Maker IP. The authentication certificate combines the authentication by Intellectual Property Publishing House, third party CA organizations and forensic institutions, and includes the important information of original works such as creation time, creator, contents and so on..

1.1.4 "I want an assertion of rights" function enables users to obtain information and services for rights assertion via Maker IP.

1.1.5 "Defensive publication" function enables users who haven't applied or are not willing to apply for intellectual property rights to publish original works on Maker IP.

1.2 The functions "I want to record", "I want to be authenticated", "I want to obtain evidences" "I want an assertion of rights" and "Defensive publication" provided by Maker IP are available for both online or client modes, and are free of charge at present.

2. Registration rules

2.1 To achieve a better experience of Maker IP's services and to facilitate Maker IP's compliance supervision, users shall provide real, correct and complete personal or organization information and update it timely. Any loss occurring due to false or outdated personal or organization information is borne by users.

2.2 After the completion of registration on Maker IP and receiving of an account and password, users shall keep the confidentiality and security of the password and account, and shall not lend it to others or permit others to use it in any other form. It's forbidden to transfer, sell or inherit and accept Maker IP accounts or passwords. If users find their accounts are used by others illegally, or there's safety loophole, they shall inform Maker IP immediately.

2.3 In any of the following cases, Maker IP is entitled to close or remove the account and all related information as well as documents in connection with that account at any time, and suspend or terminate service provision without notifying the user:

2.3.1 The user's personal information is false;

2.3.2 The user violates other rules stated in the agreement.

3. Codes of conduct

3.1 When enjoying Maker IP services, users must strictly follow the rules of relevant laws and regulations including General Principles of the Civil Law of the People's Republic of China, Law of the People's Republic of China on Guarding State Secrets, Copyright Law of the People's Republic of China, Patent Law of the People's Republic of China, Trademark Law of the People's Republic of China, Anti-unfair Competition Law of the People's Republic of China, Regulations of the People's Republic of China for Safety Protection of Computer Information Systems, Regulations on Computers Software Protection, Measures for the administrative protection of Internet Copyright, etc. and shall not make use of Maker IP to commit any kind of unlawful act or act impacting the interests of Maker IP.

3.2 Users shall not make use of Maker IP to publish, spread or upload contents that are forbidden by the laws or regulations, including but not limited to here below information:

3.2.1 Information that is contrary to the basic principles defined by the constitution;

3.2.2 Information that jeopardizes national security, leaks state secrets, subverts state regime and undermines the state unity;

3.2.3 Information that damages the nation's honor and interests;

3.2.4 Information that incites ethnic hatred and ethnic discrimination and undermines national unity;

3.2.5 Information that undermines religious state policies, and advocates heresy and feudalistic superstition;

3.2.6 Information that spreads rumors, disturbs the social order and undermines social stability;

3.2.7 Information that distributes obscenity , pornography, gambling, violence, murder and terror, or abets commission of crime;

3.2.8 Information that insults or defames others, damages other's legal rights and interests;

3.2.9 Information that contains contents of false, harmful, intimidating, infringement of others privacy, harassing, infracting, slanderous, coarse or obscene, or contents that are morally disgusting.

3.2.10 Information that incites unlawful assembly, association, protest march, demonstration or convening to disturb social order;

3.2.11 Information that is to publish speeches jeopardizing the government and laws;

3.2.12 Information that infringes other's portraiture right, right of name, right of reputation, right of privacy or other personal rights.

3.3 Users must make sure that they possess the full intellectual property rights or have obtained the legal authorization of the contents they uploaded to, published or spread on Maker IP, and the contents infringe no legitimate rights and interests of any third party, otherwise, they'll bear all legal responsibilities brought about from such.

3.3.1 Users shall not upload, publish or spread any internal or confidential information or contents that concern other's privacy or infringe any other people's patent rights, trademark rights, copyrights, business secrets or other exclusive rights.

3.3.2 Should a third party consider the contents uploaded to or published or spread on Maker IP infringe its legitimate rights and interests, and have sent reasonable notification to Maker IP, Maker IP is entitled to remove the allegedly infringing contents.

3.4 Users shall not make use of Maker IP network service system for any illegal purpose and conduct activities including but not limited to the followings:

3.4.1 Entering into computer information network or using computer information network sources without permission;

3.4.2 Removing, modifying or adding computer information network functions without permission;

3.4.3 Removing, modifying or adding the data or application programs saved, processed or transmitted in the computer information network without permission;

3.4.4 Deliberately making or diffusing computer virus and other destructive procedures;

3.4.5 Other activities which endanger the safety of computer information network.

3.5 Users shall not take advantage of Maker IP to upload or release advertisement letters or sales promotion contents.

3.6 Maker IP does not examine the contents that users save in Maker IP, and none of the Maker IP staff can see any contents users saved, either; but, Maker IP is entitled to perform necessary supervision and review over the contents published by users. If the contents published violate laws or regulations or the agreement, Maker IP is entitled to take every necessary actions depending on the specific case, including but not limited to removing concerned contents, suspending or restricting the use, deleting the account, terminating the service, and investigating for legal responsibility, etc.

3.7 Users shall undertake all civil, administrative or criminal liabilities caused by improper information they've uploaded, published or spread.

3.8 Should any user find there's content on Maker IP that violates state laws and regulations or infringes any third party's rights and interests, please report or give feed back to Maker IP, Maker IP will deal with it in accordance with law.

4. Rules on privacy

Protecting users' privacy is a basic policy of Maker IP, therefore

4.1 Maker IP will not publish, edit or disclose the registration information of users or non-public information stored on Maker IP by them, except for in the following cases:

4.1.1. Disclosure with clear authorization from the user beforehand;

4.1.2. As required by administrative or judicial authorities, disclosure to them or to the third person;

4.1.3. Other exception when it has to disclose to the public or to third party as required by relevant laws or website policies in China.

4.2 By using Maker IP's function of "I want an assertion of rights", users authorize Maker IP to share their basic registration information (only names, email addresses and contact numbers) with designated law offices, intellectual property consulting agencies and others concerned.

4.2.1 Designated law offices and intellectual property consulting agencies mentioned in the above clause refer to those that have signed cooperation agreement with Maker IP.

4.2.2 In the cooperation agreement with the designated law offices and intellectual property consulting agencies, Maker IP shall require the latter parties to make use of users basic information only for the purpose of protecting users' rights and interests or promoting business.

5. Security rules

Maker IP adopts strict technical and management means to safeguard the confidentiality and safety of users' data.

5.1 Maker IP software comprises no malicious codes aiming at damaging users data and obtaining users private information, nor any tracking and monitoring codes, and it will never gather any information such as user files or documents , and disclosure of users’ privacy is not allowed.

5.2 Maker IP establishes strict rules on the information upload process by users and safety protection measures, so as to make sure users' information collecting doesn't exceed the purpose and scope, and the information uploaded by users is safe and will not be abused. With the exception that it obtains the users' explicit consensus or it is explicitly stipulated in laws, Maker IP will not provide any third party with files or information uploaded by users.

5.3 Maker IP staff will not ask users for any kind of account or password information.

6. Rules on intellectual property

6.1 Maker IP respects the intellectual property rights and other legitimate rights and interests of people, it calls on its users to do so as well. If users find their intellectual property rights and other legitimate rights and interests are infringed, they shall provide a notification of rights to Maker IP. Maker IP will delete the charged contents according to relevant laws and regulations in China and Chinese government normative documents.

6.2 To enable Maker IP efficiently dispose the notification of rights, please follow here below format (including the serial number of each clause):

Notification of Rights

I. The ownership certificate proving the obligee holds the intellectual property rights or other legitimate rights and interests and/or can execute the intellectual property rights or other legitimate rights over the suspected infringed contents.

II. Fully and explicitly describe the infringement of the intellectual property rights or other legitimate rights and interest.

III. Provide the name of suspected infringing content and its position on Maker IP, so as to enable Maker IP to contact the user of the account that has published the content.

IV. Contact details including the full name, copy of ID card or passport (for nature persons), copy of organization's registration certificate (for organizations), postal address, phone number, fax number and email address.

V. Statement on authenticity of the content of the notification: "I promise, the information of this notification is sufficient, authentic and accurate. If the notification content is not completely true, I /our organization shall take all the legal liabilities caused by this."

VI. Signature on the notification, and stamp if the user is a lawfully established organization or institution

6.3 If the notification of rights statement is inconsistent with the facts, the notification provider shall undertake all legal liabilities (including but not limited to compensation for loss and attorney fees) . If it's not sure whether the contents published on Maker IP infringe others’ intellectual property rights or other legitimate rights and interests, Maker IP suggests to consult professionals first.

6.4 For the contents being deleted by Maker IP for above mentioned reasons, the user of the publishing account may send counter notification to Maker IP following here below instruction to explain that the contents removed do not infringe other's rights.

6.5 To enable Maker IP efficiently dispose the counter notification, please follow here below format (including the serial number of each clause):

Counter Notification

I. The ownership certificate proving that the user holds the intellectual property rights or other legitimate rights and interests and/or can execute the intellectual property rights or other legitimate rights over the contents being charged with infringing.

II. Fully and accurately specify the name of the contents required to be recovered, and its position on Maker IP.

III. Contact details, including the full name, copy of ID or passport (for nature persons), copy of organization's registration certificate (for organizations), postal address, phone number, fax number and email address.

IV. Statement on authenticity of the notification contents: "I promise, the information mentioned in this notification is sufficient, authentic and accurate. If the notification content is not completely true, I /our organization shall take all the legal liabilities caused by this."

V. Signature on the notification, and stamp if the user is a lawfully established organization or institution.

6.6 If the counter notification statement is inconsistent with the facts, the user shall undertake all legal liabilities (including but not limited to compensation for loss and attorney fee). If it's not sure whether the contents published on Maker IP infringe others’ intellectual property rights or other legitimate rights and interests, Maker IP suggests to consult professionals first.

6.7 After the counter notification being sent out, Maker IP, upon verification, can recover the contents or link deleted, and undertakes no legal liability for the recovering action by the law.

7. Disclaimer

7.1 Maker IP is unable to discriminate illegal or unauthorized use of an account and password, the act of disposition of any user who successfully logs in Maker IP is identified as the act that embodies the registered user's will. Any loss due to the user's improper safekeeping of the confidentiality of the account and password, private permission on the use by others and alike is borne by the user, and Maker IP assumes no responsibility.

7.2 Maker IP software has been carefully tested, but it can't be guaranteed that it is completely compatible with all hardware and software systems, or there is no error in it at all. In case of incompatibility or software error, the user can ring a call for technical support to report the situation to Maker IP and get technical support. If the problem can't be fixed, the user may remove the software. Maker IP is not responsible for the damage or risk caused by the use of the software or error of it.

7.3 For network services, there are risks of service interruption or failure in meeting the user's requirements caused by above mentioned force majeure, computer virus, hacker attack, system instability, internet and communication line problems, etc. Maker IP commits to make commercially reasonable efforts to safeguard the system and data security, but it can't offer any guarantee on the timeliness, safety or accuracy of the network services, and it is not responsible for the user's data damage or loss, or halting of services due to force majeure, problems of network conditions and communication lines, requirements of third party websites or administrative departments, or other causes that are not Maker IP's fault.

7.4 The platform will regularly or irregularly revise, upgrade, exam and repair or maintain Maker IP software, server, network or other related equipment in order to provide more efficient and faster services to users, and Maker IP takes no responsibility for the service interruption caused by problems of such. Maker IP reserves the rights to stop the services for the purpose of revision, upgrading or maintenance without prior notice.

7.5 Users are independently responsible for the contents uploaded to or published on Maker IP by themselves. Maker IP only provides storage space for the contents uploaded, published or spread by the users, and assumes no responsibility for the authenticity, applicability and legality of any content concerned. The person who uploads the works takes the legal responsibility for all documents, pictures, videos, application programs or other materials uploaded, published and spread by themselves, openly or privately, via Maker IP's services. Maker IP is entitled to remove the contents that infringe other's intellectual property or legitimate rights and interests and are published on Maker IP, and reserves the rights to hand it over to judicial organizations.

7.6 To secure its autonomous right of business development and adjustment, Maker IP has the rights to modify or interrupt software authorization by itself without notifying users. If it's necessary, the modification or interruption will be published in form of announcement on Maker IP's important website pages.

7.7 Maker IP doesn't guarantee that above services will be offered continuously. Maker IP is entitled to temporarily or permanently modify or terminate the services (or part of the services) at any time, and, no matter users are informed or not, Maker IP takes no responsibility for users or any third person.

7.8 If the evidence the user has obtained via the function "I want to obtain evidences" of Maker IP is not admitted by judicial, administrative or arbitration organizations, etc. for whatever reason, Maker IP assumes no responsibility.

8. Legal application and jurisdiction

8.1 The formation, change, fulfillment, interpretation and dispute settlement of the agreement is governed by the laws of the People's Republic of China.

8.2 Should any clause of the agreement is completely or partially invalid or not enforced, the clause is deemed as removed, while other clauses of the agreement shall remain valid and binding.

8.3 Any dispute arising from or in connection with the agreement shall be settled through friendly consultation; should consultation fails, either party may submit relevant dispute to Beijing Arbitration Commission for an arbitration, and the arbitral award is final and binding on parties.

9. Miscellaneous clauses

9.1 Maker IP is entitled to modify the agreement when it's necessary. Once the agreement is changed, it will be published on the official website (www.zhihuiip.com) of Maker IP, and users can log in Maker IP website to consult the latest revision of user agreement at any time. If the Maker IP members don't agree with the new contents, they can take the initiative to cancel Maker IP services they got; if the members continue enjoying Maker IP services, it'll be deemed as they accept the changes of the user agreement.

9.2 Unless it is otherwise explicitly set, new products, functions and services launched by Maker IP are all regulated by this agreement.

9.3 All Maker IP website contents including texts, software, audios, pictures, and identifications are protected by copyright, trademark, patent and other property ownership laws.

9.4 Unless with express authorization, all other rights under this agreement belong to Maker IP.

9.5 Maker IP reserves the rights of explanation and modification of the agreement to the greatest extend allowed by the laws.
